This Privacy Policy explains how Mozamboogy Festival (“we”, “us”, “the organisers”) collects, uses, stores, and protects your personal information when you register, book tickets or accommodation, attend the Festival, or otherwise interact with us. We are committed to processing your personal information lawfully and transparently in accordance with the Protection of Personal Information Act, 2013 (POPIA) of South Africa.

1. WHO WE ARE

1.1 Mozamboogy Festival is the responsible party (data controller) for the personal information described in this policy.

2. INFORMATION WE COLLECT

2.1 Account and booking information: your name, surname, email address, mobile number, currency preference, and a securely hashed password.

2.2 Identity information: where you book overnight accommodation, we collect your ID or passport details at the gate (including a scanned image processed by automated text recognition) to verify the identity of overnight guests. For day and walk-in visitors, providing ID or passport details is optional.

2.3 Payment information: we process bank transfer (EFT) payments. We store your payment reference and any proof-of-payment document you upload. We do NOT collect or store credit or debit card numbers.

2.4 Transaction and event information: your reservations, accommodation, transfers, diving trips, merchandise orders, and check-in records.

2.5 Media: by attending the Festival you may be photographed or filmed, as set out in our Terms and Conditions.

2.6 Technical information: standard server logs, session cookies, and security data. Our registration form uses Google reCAPTCHA to prevent abuse; your interaction with reCAPTCHA is subject to Google’s privacy policy.

3. HOW WE USE YOUR INFORMATION

3.1 To create and manage your account and process your bookings, payments, and refunds.

3.2 To verify identity and manage entry, accommodation, and check-in at the gate.

3.3 To communicate with you about your booking, including confirmations, vouchers, and important event updates.

3.4 To operate, secure, and improve the Festival and our booking systems.

3.5 To comply with our legal obligations and to establish, exercise, or defend legal claims.

4. LAWFUL BASIS FOR PROCESSING

4.1 We process your personal information where it is necessary to perform our contract with you (your booking), to comply with a legal obligation, to protect a legitimate interest (such as event safety and fraud prevention), or where you have given consent (such as for photography and marketing).

5. SHARING YOUR INFORMATION

5.1 We do not sell your personal information.

5.2 We may share information with trusted service providers who help us operate the Festival, such as accommodation and transfer providers, payment and banking facilitators, and email delivery services, only to the extent necessary to fulfil your booking.

5.3 We may disclose information where required by law, regulation, or a lawful request by a competent authority.

6. SECURITY

6.1 We take reasonable technical and organisational measures to protect your personal information against loss, unauthorised access, and misuse. Passwords are stored in hashed form and sensitive transfers use encrypted connections.

6.2 No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

7. RETENTION

7.1 We retain your personal information only for as long as necessary to fulfil the purposes described in this policy, including to meet legal, accounting, and reporting requirements, after which it is securely deleted or anonymised.

8. YOUR RIGHTS UNDER POPIA

8.1 You have the right to request access to the personal information we hold about you.

8.2 You have the right to request correction or deletion of your personal information.

8.3 You have the right to object to processing in certain circumstances and to withdraw consent where processing is based on consent.

9. CHILDREN

9.1 Bookings and accounts are intended for adults. Where information relating to a minor is provided, it must be provided by a parent or legal guardian.

10.1 We may update this Privacy Policy from time to time. The latest version will always be available on this page with its updated date.
